This possibility no longer exists, due to the fact that the US State Department has <a href=\"https:\/\/www.connexionfrance.com\/article\/French-news\/US-set-to-reduce-cost-of-renouncing-citizenship-for-Americans-abroad\">announced<\/a> that the fee for renouncing US citizenship will be reduced to US$450.00. For Dutch law to consider a fee paid for renunciation to be a hardship, it has to at least exceed the fee charged by Dutch law for naturalization in the Netherlands, \u20ac970.00. In general, I would also like to communicate clearly that no other hardship claim, as far as is known, has ever been honored for US citizens becoming Dutch. Since I originally published this article in 2018, I have received numerous inquiries from Americans who <em>might<\/em> lose <em>some<\/em> wealth by renouncing US citizenship, but who would still ultimately be relatively wealthy. I always explained that hardship claims are generally only honored if the financial burden incurred by renunciation would genuinely <em>impoverish<\/em> the person involved. &#8212; Jeremy Bierbach]<\/p>\n<p>The Dutch Immigration and Naturalization Service (IND) recently presented\u00a0a United States\u00a0citizen client of Franssen Advocaten to the King for naturalization, despite the fact that she was unwilling to sign a statement saying that she was willing to do everything within her power to renounce her US citizenship after becoming a Dutch citizen.<\/p>\n<p>Until now, the received wisdom was that it was impossible for US citizens to demonstrate that\u00a0renouncing their US citizenship\u00a0would cause them to suffer enough\u00a0financial hardship for Dutch law to exempt them from the renunciation requirement. Only US citizens who were married to or had a civil union (<em>geregistreerd partnerschap<\/em>) with a Dutch citizen at the moment they became naturalized received\u00a0an automatic exemption from the renunciation requirement, which effectively allowed only those persons\u00a0to be dual\u00a0citizens by naturalization. (US law, for its part, largely does not care about dual citizenship with\u00a0non-enemy states like the Netherlands, but to be absolutely certain, one\u00a0should always consult an attorney specialized in US citizenship law to be sure that acquisition of Dutch citizenship will not incur the loss of US citizenship.)<\/p>\n<p>However, due to a change in US State Department\u00a0regulations that was introduced in 2014, a fee of US$2,350.00 is now charged to any US citizen who wishes to renounce or relinquish their US citizenship. Previously, a lower fee of US$450.00 was charged in cases where the US citizen could say that they obtained their Dutch citizenship with the intention of relinquishing their US citizenship.<\/p>\n<p>Having to pay that inescapable fee, which amounts to over \u20ac2,000, would\u00a0not constitute an\u00a0<em>absolute<\/em> financial hardship for anyone:\u00a0for that, Dutch law provides that the fee would have to exceed\u00a0\u20ac8,660.00. \u00a0But in the case of Franssen Advocaten&#8217;s client, the IND accepted that the\u00a0fee could be seen as a financial hardship\u00a0<em>relative<\/em> to her income and assets, since it amounted to more than a month&#8217;s income for her; moreover,\u00a0the total value of all of her assets, as a single person, did not exceed \u20ac6,370.00.<\/p>\n<p>This particular path to dual citizenship is therefore only available to US citizens who have an immigration status (such as a long-term resident permit or residence permit for indefinite time) that does not already require them (or their non-Dutch partners) to have a particularly high income (so this path excludes most persons with a\u00a0<em>kennismigrant<\/em>\u00a0or &#8216;highly skilled migrant&#8217; residence permit), and who also do not possess any significant\u00a0wealth in the form of (e.g.) savings, real estate\u00a0or securities.
