{"id":563,"date":"2017-04-04T19:35:10","date_gmt":"2017-04-04T17:35:10","guid":{"rendered":"https:\/\/www.franssenadvocaten.nl\/english\/?p=563"},"modified":"2017-04-04T20:10:33","modified_gmt":"2017-04-04T18:10:33","slug":"council-state-rejects-government-challenge-partners-permission-work","status":"publish","type":"post","link":"https:\/\/www.franssenadvocaten.nl\/english\/council-state-rejects-government-challenge-partners-permission-work\/","title":{"rendered":"Council of State rejects government challenge to partners&#8217; permission to work"},"content":{"rendered":"<p>In August 2016, the district court of Amsterdam\u00a0handed down\u00a0a <a href=\"https:\/\/www.franssenadvocaten.nl\/english\/partners-entrepreneurs-now-also-allowed-work\/\">decision ordering the IND<\/a>\u00a0(the Dutch immigration authority) to issue a new residence permit card to a non-EU citizen\u00a0that\u00a0expressly notes\u00a0that she is allowed to work in self-employment; she lives\u00a0in the Netherlands as the spouse of an entrepreneur who, like her, is a non-EU citizen.<\/p>\n<p>The IND, acting on behalf of the responsible minister in\u00a0the Dutch government, subsequently\u00a0filed a higher appeal against the district court&#8217;s decision. The IND claimed\u00a0that although EU law does provide that such a person should have the same right to work in the Netherlands as the person they are\u00a0dependent on, and thus has the right to work in self-employment, the IND should not have to issue a new residence permit card expressly saying so.<\/p>\n<p>Franssen Advocaten filed a brief defending\u00a0the court&#8217;s decision.\u00a0The defense\u00a0noted, among other things, that if an immigrant has the right to work in self-employment, she has the right to have a document that clearly says so, in order to avoid the consequence of potential customers being afraid to do business with her.<\/p>\n<p>On 31 March, the Council of State, acting as the highest court in the area of Dutch\u00a0immigration law, rejected the IND&#8217;s higher appeal, thus establishing the district court judgment as a clear precedent binding on the IND.
