{"id":1262,"date":"2022-08-05T15:15:00","date_gmt":"2022-08-05T13:15:00","guid":{"rendered":"https:\/\/www.franssenadvocaten.nl\/english\/?p=1262"},"modified":"2022-08-05T15:23:46","modified_gmt":"2022-08-05T13:23:46","slug":"permanent-residence-for-eu-and-british-citizens-can-be-maintained-with-short-visits","status":"publish","type":"post","link":"https:\/\/www.franssenadvocaten.nl\/english\/permanent-residence-for-eu-and-british-citizens-can-be-maintained-with-short-visits\/","title":{"rendered":"Permanent residence (for EU and British citizens) can be maintained with short visits"},"content":{"rendered":"<p>The case of K.R., which had previously been\u00a0<a href=\"https:\/\/curia.europa.eu\/juris\/documents.jsf?nat=or&amp;mat=or&amp;pcs=Oor&amp;jur=C%2CT%2CF&amp;num=c-637%252F21&amp;for=&amp;jge=&amp;dates=&amp;language=en&amp;pro=&amp;cit=none%252CC%252CCJ%252CR%252C2008E%252C%252C%252C%252C%252C%252C%252C%252C%252C%252Ctrue%252Cfalse%252Cfalse&amp;oqp=&amp;td=%3BALL&amp;avg=&amp;lgrec=en&amp;page=1&amp;lg=&amp;cid=156973\">referred to the Court of Justice of the European Union<\/a>\u00a0(CJEU) by the highest Dutch immigration court, the Council of State (<a href=\"https:\/\/www.franssenadvocaten.nl\/english\/how-long-does-a-british-citizen-get-to-keep-a-right-of-permanent-residence-in-the-netherlands\/\">read the history of this case here<\/a>) was resolved on 8 April 2022, when K.R., a client of attorney Jeremy Bierbach, accepted the settlement proposal offered by the Dutch government.<\/p>\n<p>In the CJEU&#8217;s <a href=\"https:\/\/curia.europa.eu\/juris\/liste.jsf?lgrec=fr&amp;td=%3BALL&amp;language=en&amp;num=C-432\/20&amp;jur=C\">judgment of 20 January 2022<\/a>,\u00a0<em>Z.K.,<\/em> the Court had issued an interpretation of the <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:32003L0109&amp;from=NL\">Long-Term Resident Directive (2003\/109),<\/a> a piece of EU legislation providing for a right of permanent residence of non-EU citizens.\u00a0Where that Directive says that that right of residence can be lost &#8216;in the event of <span style=\"text-decoration: underline;\">absence<\/span> from the territory of the [EU] for a period of 12 consecutive months&#8217;, the Court ruled that it is not necessary to actually come back to reside in the EU before that period elapses: a visit of a few days is enough to maintain the status of long-term resident, and therefore the unconditional right of residence. This serves the interest of the long-term resident&#8217;s integration in the EU.<\/p>\n<p>The Court went out of its way to rule that this was by analogy to a comparable provision of the <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:32004L0038&amp;from=nl\">Citizenship Directive (2004\/38)<\/a>, the interpretation of which was the dispute that gave rise to\u00a0<em>K.R.:<\/em>\u00a0&#8216;Once acquired, the right of permanent residence shall be lost only through <span style=\"text-decoration: underline;\">absence<\/span> from the host Member State for a period exceeding two consecutive years.&#8217;<\/p>\n<p>The Dutch government therefore drew the conclusion that K.R.&#8217;s reading of the Citizenship Directive was the correct one: despite the fact that she had no longer actually resided in the Netherlands for many more than two years, and in fact had her main place of residence in the United Kingdom, the fact that she frequently visited the Netherlands (never being physically\u00a0<span style=\"text-decoration: underline;\">absent<\/span> for two years without interruption) was sufficient for her to maintain her right of permanent residence as an EU citizen.<\/p>\n<p>As a result, the fact that she had maintained her right of permanent residence\u00a0<em>as an EU citizen<\/em> also meant that as of the date that Brexit took effect (1 January 2021), K.R. was also entitled to a permanent residence permit as a British citizen, based on the Withdrawal Agreement of the UK from the EU.<\/p>\n<p>The Dutch government reversed its revocation of K.R.&#8217;s permanent residence status as an EU citizen, granted her a permanent residence document as a British citizen, and awarded her compensation for her legal expenses.
